You must:
- Not mislead buyers by providing false information
- Not omit important information
- Disclose material facts affecting buyer’s decision
- Be truthful in all property descriptions
Required Documents
1. Energy Performance Certificate (EPC)
- Must have before marketing
- Valid for 10 years
- Shows energy efficiency A-G
- Costs £60-120
2. Property Information Form (TA6)
Covers:
- Boundaries and disputes
- Building work and planning
- Guarantees and warranties
- Utilities and services
- Environmental matters
3. Fittings and Contents Form (TA10)
Lists what’s included/excluded in the sale
Specific Disclosures Required
Must Disclose:
- Any disputes with neighbors
- Boundary disagreements
- Building work done
- Planning permissions
- Flooding history
- Japanese knotweed
- Structural issues
Consequences of Non-Disclosure
- Buyer may withdraw or renegotiate
- Legal action after completion
- Compensation claims
- Up to 6 years to bring claims
